IGA Competition Terms & Conditions

1. Participation in The Mad Foodies IGA Competition 2024 is subject to the following terms and conditions and includes all information we provide on how to enter and prizes available. By submitting an entry into the competition, you are indicating to us that you agree to be bound by these terms and conditions. Only entries that comply with these terms and conditions will be considered valid and eligible to win.

2. The promoter is Andrews Meat Industries Pty Ltd (ABN 16 600 428 537) of 62 McRoyle Street Wacol QLD 4076 trading as Creative Food Solutions of 38 Birnie Avenue, Lidcombe NSW 2141.

COMPETITION PERIOD

3. The competition commences on 22/04/2024 at 12:00pm AEST and ends on 06/05/2024 at 11:59:59pm AEST.

WHO CAN ENTER THE COMPETITION

4. You are eligible to enter the competition if you are:

    a. a resident ordinarily residing in Western Australia (WA), South Australia (SA) or Queensland (QLD); and
    b. Aged 18 years or above; or
    c. Aged 16 years or over and have consent from a parent or guardian to enter; and
    d. Not an ineligible person.

INELEGIBLE ENTRANTS

5. If a winner is under 18 years of age, the Promoter reserves the right in its absolute and sole discretion to award the prize to the winner’s parent or guardian and to require that the parent or guardian execute such acknowledgement, indemnity and release as reasonably required in the circumstance.

6. Ineligible Person means any director, manager, employee (and their Immediate Families) of the Promoter, retailers, suppliers, associated entities and agencies associated with the competition, or any immediate family member of any of those persons. “Immediate Family” means any spouse, ex-spouse, de-facto spouse, de-facto partner, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

HOW TO ENTER THE COMPETITION

7. To enter, eligible entrants must, during the competition period:

    a. Like the post;
    b. Tag a friend in the post; and
    c. Follow ‘The Mad Foodies’ Instagram page available at The Mad Foodies (@themadfoodiesaustralia) • Instagram photos and videos

8. Sharing the post is not an entry requirement and will not increase the chances of winning. Each tag on the post equals one entry into the competition, and therefore eligible entrants can enter the competition multiple times.

9. Notwithstanding term 8, eligible entrant’s may only enter the competition a maximum of once per day per social media account.

HOW THE WINNER IS CHOSEN AND CONTACTED

10. During the competition period, all eligible entries will be tracked and entered into an online system called Shortstack.

    a. Three winners will be randomly selected via Shortstack on Thursday the 9th May 2024 at 3pm AEST.
    b. Each winner will be tagged in a post on Instagram on Friday the 10th May 2024 at 2pm AEST and directly messaged on Instagram shortly after. The winner must be following @themadfoodiesaustralia on Instagram so that the Promoter can directly message them. The Promoter will never ask winners to click a link or enter bank details to claim. For the avoidance of doubt, the Promoter will not be liable or responsible for any loss, damage, expense or otherwise arising directly, indirectly or in connection with any unauthorised access or third-party interference posing as the Promoter.
    c. Each winner has up to midnight on Friday the 17th May 2024 to respond and supply their contact and delivery details.
    d. If a winner does not respond by midnight on Friday the 17th May 2024, a second winner will be randomly selected from Shortstack.
    e. The second winner will be randomly selected from Shortstack on Monday the 20th May 2024.
    f. The second winner will be tagged in a post on Instagram on Tuesday the 21st May 2024 at 2pm AEST and directly messaged on Instagram shortly after. The winner must be following @themadfoodiesaustralia on Instagram so that the Promoter can directly message them. The Promoter will never ask winners to click a link or enter bank details to claim.
    g. The second winner has up to midnight on Tuesday the 28th May 2024 to respond and supply their contact and delivery details.
    h. If the winner of the second draw does not respond before midnight on Tuesday the 28th May 2024, the Prize will be deemed forfeited and there will be no third draw. It is at the Promoter’s discretion what they choose to do with the forfeited Prize.

PRIZES

11. Each winner will receive one $100 IGA gift card. By submitting an entry, eligible entrants agree and acknowledge that:

    a. IGA stores are independently owned and operated, and as such, not all IGA stores sell or redeem gift cards;
    b. in the event that an IGA store does not sell or redeem gift cards in the Winner’s state, the Promotor reserve all rights to provide the Winner with a Prize of equal or greater value in lieu of the $100 IGA voucher, subject to any written directions from a legislative or regulatory authority;
    c. the $100 IGA gift card Prize remain subject always to the IGA gift card terms and conditions of use and any other applicable policy outlined by IGA regarding the Prize.
    d. if for whatever reason a winner does not claim a Prize at or by the time stipulated by the Promoter, the Prize will be deemed to be fully forfeited by that Winner.
    e. The total Prize Pool is $300, comprising of three (3) separate $100 IGA gift cards. Prizes won pursuant to these terms and conditions are not transferable or exchangeable and cannot be taken as cash, unless otherwise determined by the Promoter in its sole and absolute discretion.

SOCIAL MEDIA PLATFORMS

12. By using and entering the competition on Meta, eligible entrants:

    a. Agree to fully release and hold Meta harmless from all liability in connection with the competition; and
    b. Acknowledge that the competition is in no way sponsored, endorsed, administered by, or associated with Meta.

GENERAL CONDITIONS

13. The promoter’s decision is final and binding and the Promotor is under no obligation to justify, correspond or otherwise address any communication received from entrants other than those eligible entrants selected as Winners. The promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.

14. Should an Eligible entrant’s contact details change during the competition period, it is the eligible entrant’s responsibility to notify the promoter. A request to access or modify any information provided as part of the redemption of a prize should be directed to the promoter.

15. The promoter reserves the right to request verification of the social media profile of eligible entrants and of the age, identity, location, residential address of winners and any other information relevant to entry into or participation in the competition. Verification is at the sole discretion of the promoter; whose decision is final.

16. The promoter reserves the right to disqualify any individual who submits an entry that is not in accordance with these terms and conditions, or who is involved in any way in interfering or tampering with the conduct of this competition. Failure by the promoter to enforce any of its rights does not constitute a waiver of those rights and a partial exercise of a right does not preclude any further or fuller exercise of that right.

17. If this competition is interfered with in any way or is not capable of being conducted as anticipated due to any reason beyond the control of the Promoter, including but not limited to technical difficulties, illegality, unauthorised intervention or fraud, the Promoter reserve all rights, in its sole and absolute discretion and to the fullest extend permitted by law to disqualify any entrant from the competition, or modify, suspend, terminate or cancel the competition, acting reasonably in accordance with any legislative or regulatory authority.

18. The eligible entrant agrees and acknowledges all intellectual property and copyright in the competition material and these terms and conditions vests solely with the Promoter and nothing in these terms and conditions provides any transfer, licence, assignment or other right to the entrant.

19. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective directors, officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the promotion.

20. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective directors, officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of:

    a. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    b. any theft, unauthorised access or third-party interference;
    c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    d. any variation in prize value to that stated in these Terms and Conditions;
    e. any tax liability incurred by a winner or entrant; or
    f. use of a prize.

21. Any costs associated with accessing Meta and the Promoter’s social media page is the sole responsibility of the entrant and is dependent on the internet service provider used and the entrant’s accessibility at that time.

22. The use of any automated entry software or other means which may allow an entrant via mechanically or electronically means to automatically enter repeatedly is strictly prohibited and will render all entries submitted by that entrant invalid.

23. The Promoter complies with the legislated privacy principles in relation to the collection and disclosure of information regarding individuals. The Promoter’s Privacy Policy, APP Privacy Policy and Credit Reporting Privacy Policy (“the Privacy Policies”) can be found at https://jbsfoodsgroup.com/businesses/jbs-foods-australia/accreditations-and-policies.

24. The laws of the State of New South Wales shall apply to the Terms & Conditions and the parties submit to the exclusive jurisdiction of the Courts in the Central Business District of Sydney.
